    Terms of Service

    These Terms explain how Ministry of Motion services operate, what’s included, and the boundaries of responsibility. They’re written for clarity and fair expectations — not legal theatre.

    Definitions

    • “Ministry of Motion”, “we”, “us” means the service provider operating under the Ministry of Motion name.
    • “Client”, “you” means the person or entity requesting or purchasing a service.
    • “Item” means the bike, board, or other equipment the service relates to.
    • “Service” means Suitability Assessment, Inspection & Purchase Handling, Managed Transport / Delivery, Trailhead Fit + Suspension Setup, and any related add-ons agreed in writing.

    Service Scope

    Each service is delivered as described on its respective service page and is scoped to keep outcomes clear and reliable.

    Unless agreed otherwise in writing, each booking covers one primary Item. Multi-item requests are welcome, but must be disclosed and priced as a multi-item job.

    Services are standalone. Booking one service does not create an ongoing consulting relationship or an obligation to provide further support.


    Assessments & Advice

    Suitability assessments and written commentary are provided to support decision-making. They reflect our judgement based on information you provide and information reasonably available at the time.

    You remain responsible for your final purchasing decisions, negotiations, payment methods, and risk tolerance.

    What we do not provide
    • Mechanical repairs, servicing, or workshop work
    • Medical, physiotherapy, or biomechanical fitting advice
    • Performance guarantees or “race optimisation” outcomes
    • Open-ended shopping support outside the agreed scope

    Inspection

    Inspections describe visible condition and functional observations at the time of inspection. Used equipment carries inherent uncertainty. Some issues may not be detectable without workshop-level disassembly, specialist tools, or extended riding time.

    Where possible, we document key findings (e.g. photos/video/notes). Any inspection output is limited to what can reasonably be checked in the time and access available.


    Purchase Handling

    Where purchase handling is requested and agreed, we act on your instruction for practical steps such as coordination, pickup arrangements, and handoff logistics.

    We do not act as a broker, financial intermediary, or legal representative unless explicitly agreed in writing. Seller claims, title/ownership issues, and payment disputes remain between you and the seller.


    Transport / Delivery

    Managed Transport / Delivery is designed to reduce handling risk through controlled pickup, suitable protection, and clear handoff — but transport risk can never be reduced to zero.

    Delivery method (personal delivery vs managed freight) is chosen based on route alignment, timing, and suitability. The agreed method and timing window will be confirmed before payment.

    Responsibility transfers at the agreed handoff point (e.g. pickup confirmed, delivery confirmed), documented by reasonable evidence (e.g. message confirmation, photo, signature where applicable).

    Freight and packing

    If a job requires third-party freight, packing requirements must be met. If packing is inadequate for freight, the job may pause until corrected.

    Third-party freight services operate under their own terms and conditions. We can manage selection and coordination, but we cannot control every aspect of third-party handling.


    Client Responsibilities

    • Provide accurate information relevant to the service (Item details, location, deadlines, access constraints).
    • Disclose multi-item requests upfront.
    • Ensure the seller/third party is aware of inspection/pickup arrangements where required.
    • Be reachable for time-sensitive confirmations when a job is active.

    Payment

    Payment requirements depend on the service:

    • Suitability Assessment: is a fixed scope service and paid in advance.
    • Inspection, Delivery, Trailhead Setup: confirmed first (timing/feasibility), then invoiced for payment to lock the booking.

    Where third-party costs apply (e.g. freight), these will be disclosed as part of the quote.


    Cancellations & Rescheduling

    If you need to cancel or reschedule, notify us as early as possible.

    If costs have already been incurred (e.g. travel, freight booking, paid parking, tolls), those costs may be charged at cost. Where practical, we will offer rescheduling rather than cancellation.


    Liability

    To the extent permitted by law, Ministry of Motion is not liable for indirect or consequential losses, including loss of profit, loss of opportunity, or losses arising from seller misrepresentation.

    Nothing in these Terms excludes consumer guarantees that cannot be excluded under applicable Australian Consumer Law.

    Plain-language summary

    We aim to be careful and clear. We can reduce risk, but we can’t remove all uncertainty from used equipment, seller behaviour, or third-party freight handling.


    Governing Law

    These Terms are governed by the laws of South Australia, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of South Australia.
